1. Agreement to Terms

By downloading, installing, or using ClearNoteCheck ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ClearNoteCheck regarding your use of the App.

2. Description of Service

ClearNoteCheck is an AI-powered meeting notes application that provides:

• Audio recording of meetings and conversations
• AI-powered transcription of recorded audio
• Automatic speaker identification and labeling
• AI-generated summaries, action items, and key points
• Multiple professional report formats
• AI chat functionality for meeting inquiries
• Export capabilities to PDF and HTML formats

3. User Responsibilities

By using ClearNoteCheck, you agree to:

• Obtain Consent: You are responsible for obtaining all necessary consents before recording any conversation or meeting. Recording laws vary by jurisdiction, and you must comply with all applicable laws.
• Lawful Use: Use the App only for lawful purposes and in accordance with these Terms.
• Accurate Information: Provide accurate information when required.
• Account Security: Maintain the security of your device and any account credentials.
• Content Responsibility: You are solely responsible for all content you record, store, and share using the App.

4. Prohibited Uses

You may not use ClearNoteCheck to:

• Record conversations without proper consent where required by law
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Harass, abuse, or harm another person
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to any systems or networks
• Use the App for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble the App

5. Subscription and Payments

ClearNoteCheck offers both free and premium subscription tiers:

• Free Tier: Limited features with a monthly recording limit.
• Pro Subscription: Full access to all features on a monthly or annual basis.
• Lifetime Purchase: One-time payment for permanent access to all features.

Payments are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription in your device's account settings.

Refunds are handled according to the policies of the respective app store.

6. Intellectual Property

The App and its original content, features, and functionality are owned by ClearNoteCheck and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all content you create using the App, including recordings, transcriptions, and reports. By using the App, you grant us a limited license to process your content solely for the purpose of providing our services.

7. AI-Generated Content

The App uses artificial intelligence to generate transcriptions, summaries, and other content. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• Transcriptions are provided "as-is" and should be reviewed for accuracy
• You are responsible for verifying the accuracy of any AI-generated content before relying on it
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content

8. Disclaimer of Warranties

We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARNOTECHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any errors or inaccuracies in AI-generated content
• Any third-party content or conduct

10. Indemnification

You agree to defend, indemnify, and hold harmless ClearNoteCheck and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
